A Quick Overview Of Divorce In Kentucky
To get a divorce in Kentucky, you must follow the requirements to get a “dissolution of marriage” order from the court. They are:
- Residency: You or your spouse must be a resident of the state of Kentucky for at least 180 days prior to filing for divorce.
- Agreement: Both parties must come to a full agreement on all the matters of the divorce from child custody to property division
- Waiting period: The court requires that all couples going through divorce be without “sexual cohabitation” for 60 days before finalization.
Additionally, there is an option to get a legal separation in Kentucky called “divorce from bed and board,” which is a recognized legal status, but it does not allow you to marry someone else at that time. If you receive this form of separation, after a year you can pursue this change to a full divorce decree.
Grounds For Divorce In Kentucky
When you can meet the requirements of an uncontested divorce in Kentucky, your separation could likely be considered the “best case scenario.” However, the best case scenario isn’t always likely. A more contentious divorce process can start with the grounds for the divorce: when cheating, stealing, abuse or other unhealthy situations cause a split.
Luckily for most instances, Kentucky is a no-fault divorce state. This means either party can initiate the end of a marriage and not have to provide a show of fault. They would simply consider it an irreconcilable difference and move on.
Prior to the creation of no-fault divorce decades ago, the only way to end a marriage was to find that the other spouse had broken the marital contract in some way. This always increased the cost of divorce and extended marriages unnecessarily as people fought tooth and nail to get out of relationships that didn’t work any more.
While divorce is always a serious emotional weight, being able to secure a divorce without having to dredge up every aspect of your personal life and relationship is a win.
Divorce’s Impact On Your Children And Family Dynamics
In Kentucky, family is a major and important part of how communities are built and come together. A divorce can impact the dynamics of your relations with your children and your entire family in many important ways.
But not all divorces are bad.
For example, statistically speaking many children experience better mental health when their unhappily married parents divorce. The pressures of living in a house with two people who don’t want to work together or be together place immense strain on the kids. Ending that situation is often the most compassionate choice.
Still, your family dynamics will change. You will have less time with your children. You will have less financial freedom and less overall property. However, if you think it’s time to end your marriage, then we can help.
